Welcome to OnsiteSetup! These Terms & Conditions govern the services we provide to our clients. By engaging with our services, you agree to these terms in full. Please read them carefully before using our services.

1. Definitions

  • Client: The individual or business engaging OnsiteSetup for services.
  • OnsiteSetup: Refers to the service provider (our company).
  • Contractors: The third-party professionals we assign to work on client projects.

2. Scope of Services

OnsiteSetup provides project management, contractor sourcing, and onsite support for business projects. The specific services will be outlined in a separate agreement or proposal prior to the start of any project.

  • Any changes to the scope of work must be agreed upon by both parties and may result in additional costs or changes in the project timeline.

3. Engagement and Payment Terms

  • Proposals & Estimates: We will provide the client with a detailed project proposal outlining costs, timelines, and deliverables. This proposal must be approved before work commences.
  • Payment Structure: Payments are structured on a per-hour or per-project basis as defined in the proposal. A deposit may be required to begin the project.
  • Late Payments: Payments not received within the agreed timeframe may result in project delays or suspension of services. Interest may be charged on late payments at a rate of 2% per month.
  • Cancellations: Cancellations must be made in writing. The client will be responsible for any work completed up to the point of cancellation and any non-refundable costs incurred on their behalf.

4. Contractor Responsibility

OnsiteSetup carefully vets all contractors before assignment to a project. However, we are not responsible for any liabilities or damages caused by third-party contractors during the project.

  • The client will be informed of the contractors’ qualifications before the project begins.
  • OnsiteSetup serves as a liaison between the client and contractor, ensuring communication and quality control throughout the project.

5. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information shared during the project. This includes project details, financial information, and other sensitive data.

  • OnsiteSetup agrees not to disclose client information to third parties without explicit consent, except for the contractors involved in the project.

6. Liability and Warranty

  • OnsiteSetup is committed to providing quality service; however, we are not liable for indirect, incidental, or consequential damages related to the project.
  • We do not guarantee specific project outcomes unless expressly stated in the proposal or agreement.
  • Clients are responsible for clearly communicating all project requirements. Any discrepancies must be brought to our attention within 7 days of project delivery for rectification.

7. Force Majeure

OnsiteSetup is not responsible for delays or failure to perform caused by unforeseen events beyond our control, including but not limited to acts of nature, labor disputes, accidents, or governmental actions.

8. Termination of Agreement

Either party may terminate the agreement by providing a 30-day written notice. Termination without cause before the project’s completion will result in payment for work completed up to the termination date.

  • If OnsiteSetup terminates the contract, any unused funds for services not rendered will be refunded to the client.

9. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the jurisdiction in which OnsiteSetup operates.

10. Amendments

OnsiteSetup reserves the right to modify these Terms & Conditions at any time. Clients will be notified of any changes, and continued use of our services after amendments constitutes agreement to the revised terms.
